These Terms and Conditions apply to Coles Plus subscriptions purchased from 30 October 2024.
Subject to these Terms and Conditions, Coles Plus is a subscription service that covers the cost of home delivery fees for online purchases (an Order) from coles.com.au (Coles Online) and any applicable fees for Orders collected from Click & Collect Rapid locations (where available).
The subscription is valid for purchases from Coles Online during the relevant Subscription Period each time a customer spends $50 or more in a single transaction, after savings and discounts have been applied.
Service fees, smoking and tobacco products are excluded from the minimum spend threshold.
Subscriptions are to be paid monthly or annually as nominated at time of subscribing. Monthly subscriptions cost $19.00 a month, annual subscriptions cost $199.00 a year. Customers may receive a free one-month trial upon subscribing to the service for the first time.
By purchasing the Coles Plus subscription, you agree to be bound by these Terms and Conditions which are to be read in conjunction with Coles Online Customer Agreement.
Capitalised terms can be found in the 'Definitions' section, which appears at the end of these Terms and Conditions.
Conditions of Use
- Coles Plus is an opt-in paid subscription service and requires you to sign up to participate in the Coles Plus offer.
- The Coles Plus subscription is only valid for purchases from Coles Online during the relevant Subscription Period every time a customer spends $50 or more in a single transaction, after savings and discounts have been applied. We may change the minimum amount from time to time by giving you 30 days’ notice. Service fees, smoking and tobacco products are excluded from the minimum spend threshold. You have the right to cancel your subscription at any time as per clauses 31 to 34.
- You may only use the Coles Plus subscription for delivery to a maximum of two different delivery locations.
- The Coles Plus subscription strictly only covers the Delivery Fee and does not cover any other fees or charges that we may charge from time to time in connection with Coles Online, First Choice Liquor Market, Liquorland (including Liquorland Warehouse and Liquorland Cellars) and Coles Express during the Subscription Period. Same day delivery (provided by our Partner delivery service) is available at select locations for online orders at Coles placed before 11am until sold out. The service excludes liquor and smoking/tobacco purchases and some bulk items. A limit of 70 products per order applies. Find out more about same day delivery.
- The Coles Plus subscription is for the sole use of the account holder and cannot be transferred to or used for Orders for another customer and cannot be used in conjunction with any other offer in relation to Delivery Fees.
- Liquor delivery may not be available in certain areas (please see our List of Areas we don’t currently service for more information) and may be subject to further purchase conditions (please see Orders with Liquor and Tobacco for more information).
- The Coles Plus subscription is valid to use any day of the week throughout the relevant Subscription Period and costs $19.00 per month for the monthly plan, or $199 per year for an annual plan.
- Delivery is subject to the Coles Online Customer Agreement and the Coles Liquor Terms of Use for Website.
Free trial
- Your Coles Plus subscription may start with a free trial. If applicable, the duration of the free trial period will be for one month starting from the date you sign up for a Coles Plus subscription.
- We may consider you ineligible for a free trial if your use of the Coles Plus subscription is unreasonable or unacceptable in accordance with clause 46 to 48 (Fair Use).
- We will charge the Subscription Payment to your Nominated Card at the end of the one month free trial period unless you cancel the Coles Plus subscription before the first Billing Date.
- You may cancel your Coles Plus subscription during the free trial period by updating your account preferences at coles.com.au and selecting ‘Cancel Subscription’ via the ‘Coles Plus subscription’ link. Coles Plus benefits
- As part of your Coles Plus subscription, you will receive unlimited free delivery for online orders at Coles when you spend $50 or more in one transaction, after savings and discounts have been applied. Free delivery is not available for remote delivery orders. We’ll tell you if we don’t deliver to your area when you enter your address.
- As part of your Coles Plus subscription, you will receive access to a Priority Customer Care phone line and email address to resolve any issues or concerns. The Priority Customer Care line may be used for other Coles customers in exceptional circumstances.
- Click & Collect Rapid service is available when you spend a minimum of $30 in one order after savings and discounts have been applied. Offer is available in selected areas only and some product exclusions apply. A limit of 40 products and a $5 fee per order applies. There are limited Rapid time slots available please refer to our website for timeslot availability. Due to the fast nature of the Click & Collect Rapid service, you cannot modify or cancel a Click & Collect Rapid order at any time after placing the order and you may be subject to a cancellation fee.
- From time to time, you may be selected to participate in trials to receive free product samples or gifts from Coles Plus or our partners. You will be notified if you are selected for the trial. If you do not want to receive free product samples or gifts, you can opt out by contacting the Coles Plus Priority Customer Care team. - From time to time, we may issue customers with Coles Plus promotional codes to adjust the Coles Plus subscription charge. These promotional codes are specific to the customers they are issued to and cannot be transferred or sold. The subscription promotional codes are subject to the specific offer terms disclosed to customers at the time of issue. We reserve the right to cancel any or all subscription promotional codes at any time if we suspect error, fraud or any other abuse of the codes is occurring.
2x Flybuys points on Coles Online, and in-store Coles Supermarkets, First Choice Liquor Market and Liquorland (including Liquorland Warehouse and Liquorland Cellars) purchases
- Flybuys members with a Coles Plus subscription who have linked their Flybuys member number to their Coles account via Coles Online or the Coles app will collect 2 points per $1 for qualifying spend at Coles Online, and in-store at Coles Supermarkets, First Choice Liquor Market and Liquorland (including Liquorland Warehouse and Liquorland Cellars). 2x points equals 1 standard Flybuys point and 1 bonus point per $1 spent per eligible transaction, no 2x points on individual bonus points offers.
- Once a Flybuys member number is linked to their Coles account via Coles Online or the Coles app, Coles Plus members can scan a) either the Flybuys card barcode or the Coles app barcode at the time of purchase in-store at Coles Supermarkets; or b) the Flybuys card barcode at First Choice Liquor Market and Liquorland (including Liquorland Warehouse and Liquorland Cellars) to collect 2 points per $1 spent on eligible products (excludes Coles Express and online liquor purchases).
- If at any time your Flybuys member number is not linked to your online Coles account, scanning both the Coles app barcode and an unlinked Flybuys card in one transaction in store will remove the first barcode scanned and its benefits will not be applied.
- Points awarded after savings, discounts and vouchers. Excludes purchases of all gift cards, iTunes cards, Coles Best Buys Online Exclusive products, charity items/donations, tobacco and tobacco related products, online liquor purchases, online delivery fees, Coles Plus subscription fees, Liquorland Warehouse, eBay, DoorDash, Menulog and Uber Eats purchases. - The number of Flybuys points awarded is calculated by reference to the Australian dollar amount of the transaction. Your Flybuys card number must be entered or scanned at time of purchase and linked to your Coles Online account.
- Liquor must not be sold or supplied to persons under 18. Flybuys and its liquor partners support ID25, DrinkWise (get the facts drinkwise.org.au) and the responsible enjoyment of alcohol.
10x Flybuys points on online liquor purchases at Coles Online, First Choice Liquor Market and Liquorland (including Liquorland Warehouse and Liquorland Cellars)
- Flybuys members with a Coles Plus subscription who have linked their Flybuys member number to their Coles account via Coles Online or the Coles app and entered their Flybuys membership account details when placing an online order for liquor purchases at Coles Online, First Choice Liquor Market and Liquorland (including Liquorland Warehouse and Liquorland Cellars), will collect 10 points per $1 for qualifying spend for liquor purchases made online at Coles Online, First Choice Liquor Market and Liquorland (including Liquorland Warehouse and Liquorland Cellars) (excludes in-store purchases). 10x points equals 1 standard Flybuys point and 9 bonus points per $1 spent per eligible transaction, no 10x points on individual bonus points offers.
- Points awarded after savings, discounts and vouchers. Excludes online delivery fees and Coles Plus subscription fees. Standard Flybuys terms and conditions apply.
- The number of Flybuys points awarded is calculated by reference to the Australian dollar amount of the transaction. Your Flybuys card number must be entered at time of purchase and linked to your Coles Online account.
- Liquor delivery may not be available in certain areas (please see our List of Areas we don’t currently service for more information) and may be subject to further purchase conditions (please see Orders with Liquor and Tobacco for more information).
- Orders taken and fulfilled by Liquorland Australia Pty Ltd ABN 82 007 512 414 (Licence Numbers 6020029967, 14005558, 32059704, 80063, LIQP770010162, 50102218, LIQP700382090 [Type of licence – Tavern licence. Name of licensee – Queensland Venue Co. Pty Ltd. Address – 1120-1124 Albany Highway, Bentley WA 6102. Telephone number – (08) 6254 6200]) in accordance with liquor licensing laws. This offer is not available in stores and exclude the Port Hedland and South Hedland, WA and NT areas. All orders must be placed and received by persons aged 18 years or older, proof of age must be supplied on request. Exclusions
- Coles Plus subscription is not valid for use for remote delivery orders.
Auto-renewal, Cancellations and Refunds
- The Coles Plus subscription is an ongoing subscription. Your Coles Plus subscription as well as your obligation to pay the monthly or annual Subscription Payment will perpetually auto-renew at the end of the Subscription Period unless you give us notice that you wish to cancel.
- You may cancel the auto-renewal of your Coles Plus subscription at any time by notifying us by visiting your account preferences at coles.com.au and selecting ‘Cancel Subscription’ via the 'Coles Plus subscription' link. You may also cancel your Coles Plus subscription by contacting Coles Plus Priority Customer Care team via email on colespluspriority@online.coles.com.au, via text on 0429 989 656 or via phone on 1800 508 308.
- The cancellation of your Coles Plus subscription will take effect from the end of the relevant Subscription Period. You will continue to have the benefit of the Coles Plus subscription for the remainder of the relevant Subscription Period that has been prepaid. You will not be refunded for the remainder of the Subscription Period in which you cancel the auto-renewal of your Coles Plus subscription.
- You have the right to change your mind and cancel your Coles Plus subscription within 14 days of your Billing Date provided you have not used your Coles Plus subscription in that time. If you wish to get a refund of the Subscription Payment for the Subscription Period that has been prepaid, you must contact our Coles Plus Priority Customer Care team via email on colespluspriority@online.coles.com.au, via text on 0429 989 656 or via phone on 1800 508 308 and we will issue you with a refund of the Subscription Payment for the Subscription Period that has been prepaid. Once your account is cancelled you will not be able to continue to use your Coles Plus subscription.
- If there are any extenuating circumstances relating to your Coles Plus subscription or your ability to make the Subscription Payment, please contact our Coles Plus Priority Customer Care team via email on colespluspriority@online.coles.com.au, via text on 0429 989 656 or via phone on 1800 508 308.
Charging your Nominated Card
- You must pay the Subscription Payment on each Billing Date during your relevant Subscription Period. If your Billing Date falls on a day which does not exist within a given calendar month, you will be billed on the last day of that month. For example, if you signed up on the 31st of March, then you will be next billed on the 30th of April for that Subscription Period.
- Any amounts charged to your Nominated Card that exceed the funds or credit limit available on the Nominated Card may be rejected and may result in you being charged fees or interest by the issuer of the Nominated Card.
- To the extent permitted by law, we are not liable for any loss arising from and any costs incurred in connection with:
- us being unable to charge the Subscription Payment to your Nominated Card;
- any unsuccessful payment by you of the Subscription Payment using your Nominated Card (including a chargeback or a failure by you to update your details);
- you being required to pay the Subscription Payment to us in any other way; or
- a variation or termination of these terms and conditions, except to the extent that this is due to our negligence, fraud, wrongful act or omission.
- Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law.
- You authorise us to charge the Subscription Payment to your Nominated Card on each Billing Date. The Subscription Payment and the Billing Date will be disclosed to you at the time that you purchase the Coles Plus subscription.
- It is your responsibility to ensure that you are able to pay the Subscription Payment on the Billing Date using your Nominated Card and that your Nominated Card details and contact details are up-to-date during the Subscription Period.
- You warrant that you are over 18 years of age and have the capacity and authority to authorise us to charge the Nominated Card.
- If you believe there has been an error in charging your Nominated Card or you wish to notify us about anything relating to these Terms and Conditions, including disputes, please contact our Coles Plus Priority Customer Care team via email on colespluspriority@online.coles.com.au, via text on 0429 989 656 or via phone on 1800 508 308.
- You must pay for the Coles Plus subscription on a monthly or annual basis, as nominated at time of subscribing.
Payment Failure
- If you fail to pay the Subscription Payment by the Billing Date for any reason (including in relation to a chargeback or failure by you to update your payment details), we will give you 48 hours to rectify your payment details for a subsequent attempt of the Subscription Payment. If not rectified and the Subscription Payment is not successfully processed post this time, we will cancel your Coles Plus subscription.
Cancelled Account
- If your Coles Plus subscription is cancelled, you will not be able to continue to use it and will need to purchase another Coles Plus subscription.
Fair Use
- You may not use the Coles Plus subscription in a manner which is unreasonable or unacceptable and we reserve the right to monitor usage of your Coles Plus subscription for this purpose.
- For the purposes of clause 47, unreasonable or unacceptable use means:
- using your Coles Plus subscription in circumstances where you have provided us with false user information (including creating multiple false accounts to receive multiple free trials);
- by contravening any applicable laws when you use the Coles Plus subscription service;
- using your Coles Plus subscription in any manner which improperly interferes with another person’s use of the Coles Plus subscription service or for illegal, unlawful or fraudulent purposes;
- using your Coles Plus subscription in any manner which Coles determines (acting reasonably) is unreasonable or unacceptable, having regard to its legitimate business interests.
- Where we reasonably determine that you are using your Coles Plus subscription in an unreasonable or unacceptable manner, we may ask you to stop doing so. You must immediately comply with any such request. If you do not, then we may take any steps reasonably necessary to ensure compliance with these Terms and Conditions, which may include cancelling your Coles Plus subscription immediately and without notice to you.
Privacy
- We ensure that your personal information is protected and maintained in accordance with the Privacy Act 1988 (Cth).
- Our Privacy Policy explains how we collect, use and disclose personal information about you, including how to opt out from direct marketing, how to request access to and correction of your personal information or how to complain about a privacy breach and how this is handled by us. General
- We may vary these terms and conditions at any time and we will notify you of any material changes, including cancelling the Coles Plus subscription service, by giving you at least thirty (30) days’ notice. You have the right to cancel your Coles Plus subscription at any time in accordance with clauses 31 to 34.
Definitions
Billing Date means the day you purchase the Coles Plus subscription and the date that is every month after that date during the Subscription Period, as notified at the time you purchase the Coles Plus subscription. For free trials, the first Billing Date is one month after you sign-up for the Coles Plus subscription. For free trials, the first Billing Date is one month after you sign-up for the Coles Plus subscription.
Coles Express means Viva Energy Retail Pty Ltd (ABN 96 662 372 027), trading as Coles Express.
Coles Group means Coles Group Limited (ABN 11 004 089 936) and each of its related bodies corporate from time to time.
Coles Supermarkets means Coles Supermarkets Australia Pty Ltd (ABN 45 004 189 708).
First Choice Liquor Market means Liquorland Australia Pty Ltd (ABN 82 007 512 414 - First Choice Liquor Market), and its affiliated website www.firstchoiceliquor.com.au
Flybuys means Loyalty Pacific Pty Ltd (ABN 82 057 931 334).
Liquorland means Liquorland Australia Pty Ltd (ABN 82 007 512 414 - Liquorland), and its affiliated website www.liquorland.com.au
Liquorland Cellars means Liquorland Australia Pty Ltd (ABN 82 007 512 414 - Liquorland).
Liquorland Warehouse means Liquorland Australia Pty Ltd (ABN 82 007 512 414 - Liquorland).
Nominated Card means the debit or credit card or PayPal account you have nominated in connection with your Coles Plus subscription online, or by subsequent notification to us and which, under these Terms and Conditions, we are authorised to charge the Subscription Payment.
Subscription Payment means the subscription payment amount for your Coles Plus subscription that is applicable to your plan and disclosed to you at the time of purchase.
Subscription Period means:
(a) where a monthly subscription is nominated at the time of subscribing: one month from the date on which you purchased your Coles Plus subscription and each successive one-month period in which the Coles Plus subscription is renewed; or
(b) where an annual subscription is nominated at the time of subscribing: one year from the date on which you purchased your Coles Plus subscription and each successive one-year period in which the Coles Plus subscription is renewed.
Terms and Conditions means these Coles Plus subscription Terms and Conditions.
We, Us and Our means the entity or entities within the Coles Group that enters into these Terms and Conditions with you, including without limitation Coles Supermarkets Australia Pty Ltd (ABN 45 004 189 708) and Liquorland (Australia) Pty Ltd (ABN 82 007 512 414).
Subscription Retention Offer
An offer encouraging a Coles Plus member to retain their subscription may be presented at the time of cancellation. Offer is valid for purchases made at coles.com.au. Offer excludes delivery to remote areas. To check whether we deliver to your area, visit coles.com.au. The specified offer will be activated once a Coles Plus member has selected the button to continue their membership via the page the offer is displayed, and after the next scheduled Coles Plus subscription payment has been successfully processed. Offer discount is automatically applied at checkout for the next eligible online order after the criteria above have been met. Minimum online order spend of $70 applies. Offer valid after savings and discounts and excludes purchases of all gift cards, iTunes cards, Coles Best Buys Online Exclusive products, charity items/donations, tobacco and tobacco related products and online delivery fees. Offer can only be redeemed once per Coles Plus account. Order cut-off times apply (incl. 1am Sat/Sun in some stores on weekends).
