Governing law for Google Transit

Hi,

If a Transit agency in India has to publish its static data to Google Maps, Google presents an agreement that needs to be signed by the Transit agency. The agreement states that the agreement will be governed by the state of California.

Agencies in India would most likely not accept this agreement as the laws of another country are applicable. What is the best way around this? What have other non-US cities in the world done about this agreement?

Those agencies have signed an NDA. I leave it at that.
