Supreme Court's Chevron ruling underscores the need for clear Congressional action on AI regulation "Congress will need to expressly delegate the authority for a technically literate AI safety regulator" WASHINGTON, DC - On Friday, June 28, the Supreme Court reduced the power of federal agencies to interpret the laws they administer. It ruled that courts should rely on their own interpretation of ambiguous laws. Jason Green-Lowe, Executive Director of the Center for AI Policy (CAIP), a nonpartisan research organization that develops policy and conducts advocacy to mitigate catastrophic risks from AI, released the following statement: "Today, the Supreme Court overruled the Chevron doctrine. The Court's new ruling requires judges to exercise independent judgment when interpreting an ambiguous law instead of referring to a regulatory agency's interpretation of what the law should mean. This highlights the downside of leaving AI safety policy up to dozens of individual agencies: as Justice Kagan points out in her dissent, existing regulators do not have enough authority to do the job. "There is widespread agreement that AI is evolving too quickly for Congress to pass a new law on the topic every time the technology changes. As a result, Congress will need to expressly delegate the authority for a technically literate AI safety regulator to adjust our policies. "The Loper Bright Enterprises decision does not bar Congress from delegating this authority, but it requires Congress to speak clearly. CAIP urges Congress to speak clearly, quickly, and firmly to protect America against the increasing threats from advanced, general-purpose AI. Section 6(g) of our model legislation offers suggested language to accomplish this goal, and we encourage interested parties to include similar language in their post-Chevron legislation." ###

Norma Krayem, Van Scoyoc Associates Vice President and Chair of the Cybersecurity, Privacy & Digital Innovation Practice discussed the federal government’s ongoing AI regulatory efforts with Charlie Mitchell of Inside AI Policy. Norma stated that “AI use is more complex, but the premise of regulation should be the same as for other technologies.” According to Norma, “the difference with AI is we’re creating something that will be smarter than we are. It’s an existential prerequisite that we understand that and look ahead to the risks.” “Don’t replicate the problems we’ve seen in cyber,” Norma said. She also observed that agencies are working on AI use cases for the sectors they regulate under guidance from the Office of Management and Budget, saying the agencies “understand their sectors best” and should be focused on “outcome-based regulations.” And, Norma noted, “the discussion between government and the AI community is critical.” “Norma said, “we know so much more now about technology risk and we need to harness that knowledge to address AI models.” “The next step should be each agency assessing where they are and to assess the appropriate resources they will need,” Norma said. “The one-year anniversary of the EO [on Oct. 30] allows the White House and agencies to analyze where they are, and the FY 2026 budget process provides an opportunity,” indicated Norma. #governmentcontractors #cyberincidentreporting #cybersecuritymandates #regulatorypolicies #cybersecurity #AI To read the full article, click here:

Now that Governor Newsom has vetoed the AI safety bill SB 1047, we are hopeful that he will make good on his promise to introduce new legislation that addresses the protections we need. With AI advancements moving so rapidly, developing a perfect piece of legislation is impossible. But this is a classic situation where perfect shouldn’t be the enemy of good. The USPTO has been ahead of the curve on AI for IP, as our recent episode with Jerry Ma and Charles Kim illustrates. Jerry, the USPTO’s Chief AI Officer, and Charles, chair of its AI and Emerging Technologies Working Group, have been coordinating the office’s AI activity since 2019, before ChatGPT. What’s more, their approach exemplifies the recommendations on adoption Tradespace made in its whitepaper predicting that 2024 would be the year AI could no longer be ignored. How so? 1. It’s human-first — The USPTO prioritizes empowering examiners rather than replacing them. As Jerry shares, they understand that "trust only comes from expert examiners,” so they should remain "firmly in the driver’s seat.” 2. It’s cross-functional — The working group brings together technologists and policy experts in addition to examiners. Says Charles, “There are just too many different angles” for any one skillset to tackle alone. New bid today for 300 xxxxx media players from California Department of Tax and Fee Administration -- “The State of California seeks to realize the potential benefits of GenAI, through the development and deployment of GenAI tools, while balancing the risks of these new technologies. Bidder / Offeror / Contractor must notify the State in writing if their solution or service includes, or makes available, any GenAI technology, including GenAI from third parties or subcontractors. The State has developed a GenAI Reporting and Factsheet (STD 1000) to be completed by the Bidder / Offeror / Contractor. Failure to submit the GenAI Disclosure & Factsheet (STD 1000) will result in disqualification of the Bidder / Offeror / Contractor. Failure to report GenAI to the State may void any resulting contract. The State reserves its right to seek any and all relief it may be entitled to as a result of such non-disclosure. Upon receipt of a Bidder / Offeror / Contractor GenAI Reporting and Factsheet (STD 1000), the State reserves the right to incorporate GenAI Special Provisions into the final contract or reject bids/offers that present an unacceptable level of risk to the State.”
