Non-state actors play a multifaceted role in shaping humanitarian law and human rights through advocacy, participation in legal processes, and efforts to fill regulatory gaps. Their influence is critical in promoting accountability and ensuring that international legal frameworks evolve to address contemporary challenges. However, the lack of clear legal status and accountability mechanisms for NSAs remains a significant challenge that the international community must address to enhance the effectiveness of humanitarian law and human rights protections.

But what are its limitations? 🤔 👨🏿⚖⚖ Human rights lawyer and public law expert Dr. Musa Kika highlights that, in terms of enforcement, domestic law often carries more weight than international law. 🛑 Why prioritize domestication? Dr. Kika observes that in many countries facing human rights challenges, especially across Africa, the ICCPR often encounters resistance. Many see it as a form of external imposition or a tool for Westernization. 🔑 How do we achieve domestication? The Scottish Government has failed to address the urgent need for investment in access to justice and legal aid in its 2024-25 Programme for Government. While the Programme includes several positive measures, including ongoing support to reduce court backlogs and funding to better support victims and witnesses of crimes, it fails to properly fund legal aid practitioners. This underfunding risks undermining improvements in the justice system and further eroding access to justice, especially for the most vulnerable in the community. Our President, Susan Murray commented, “This underfunding of legal aid is a longstanding issue with a negative impact which compounds with each passing year. As the March Indigenous Law Insights webinar presenter, associate Brodie Noga addressed recent case law and legislative developments in British Columbia. He discussed the B.C. Court of Appeal’s ruling that private parties can be liable for the tort of nuisance for interfering with Indigenous rights to water and land use. On the legislative front, the B.C. government has proposed amendments to the Land Act which would provide for greater joint decision-making with Indigenous groups.
