Alleged Infringement

I represent Thimblepress, the creator of the Push-Pop Confetti™ product. It has been brought to our attention that you market and sell a line of “Confetti pop ups”and 'Confetti push ups" through your Etsy storefront. Unfortunately, your items could easily cause substantial confusion to a consumer looking for Thimblepress' original product, and thus it appears that your marketing and sale of these products violate the rights of Thimblepress under United States trademark and trade dress laws, and Thimblepress must demand that you cease and desist from selling, marketing, creating, distributing, exchanging, displaying, and listing these products immediately.

I regret to inform you that, if you persist with the sale of these products after this notice, Thimblepress will consider any and all necessary legal proceedings against you. In those proceedings, we will seek all available legal remedies, including legal fees. Thimblepress also reserves the right to pursue all other available legal options to enforce its intellectual property rights.
