A police spokesperson confirmed to PEOPLE on Dec. 12 that the Burbank Police Department was called to the Vanderpump Rules alum's Los Angeles home on Tuesday, Dec. 10, "regarding an argument between a man and a woman."
Authorities did not say whether the woman involved was Lewber, but noted that their investigation "determined it was a domestic incident, leading to [Kennedy's] arrest." The DJ was "booked for misdemeanor domestic violence and later posted bail. Formal charges are pending review by the Burbank City Attorney’s office."
According to TMZ, who was first to break the news, citing a law enforcement source, a witness reportedly saw Kennedy become physical with the woman, but authorities did not see any injuries when they arrived on the scene. He was released on $20,000 bail, the outlet reported.
Kennedy's attorneys later issued a statement to PEOPLE about the alleged incident, saying: "We are in the process of conducting our own investigation into the allegations levied by the Burbank Police Department against James. We understand that there were no injuries and we are hoping that, after careful review, the city’s attorneys will decide not to file formal charges."

Kennedy and Lewber began dating in January 2022, just over a month after Kennedy ended his engagement to his VPR costar Rachel (formerly Raquel) Leviss. The couple first met at a concert for Tom Sandoval’s band, The Most Extras.
Lewber later admitted she had been a fan of the Bravo show, telling Andy Cohen during the show’s season 10 reunion, "I had seen Vanderpump Rules. During COVID, I went down the Bravo rabbit hole."
Lewber has stuck by Kennedy's side ever since, saying that “meeting him [was] different," despite his controversial past on VPR. "I gave him a chance to really show me who he is," Lewber recalled, adding that “he's lovely."
In June 2023, the two moved in together to a house in Burbank, Calif. The spacious abode has three bedrooms, a swimming pool and a DJ studio for Kennedy.
