This program has the potential to be great, but there are concerns that employees are taking advantage of it. Once approved, employees can choose whether or not to continue medical care and even leave the state. If they work for an employer with 50 or more employees, they are legally allowed to return to their job or equivalent. Furthermore, employees can claim any number of hours per week, up to 40, and their employer won't know what they claim or how much their payments are. It is believed that people are using this program to take three-month paid vacations. Mental health challenges such as anxiety, stress, and PTSD are increasingly impacting employees' well-being and productivity. In 2024, disability discrimination claims became the second most frequently reported issue to the EEOC, underscoring the critical need for employers to prioritize ADA compliance and mental health accommodations. As Human Resources professionals, it’s essential for us to recognize the signs of mental health struggles and proactively offer the support, resources, and accommodations our staff need to thrive. By doing so, we create a healthier, more inclusive workplace where everyone feels valued and supported.
