Who Can File a Wrongful Death Claim in California? Only certain family members have the legal right to file these lawsuits in California: The surviving spouse; The surviving domestic partner or putative spouse; or The decedent’s surviving children and grandchildren. The right to file becomes a bit more complicated if the decedent does not have a surviving spouse, a domestic partner, children, or grandchildren. Under California probate laws, someone with the right to inherit the decedent’s assets can file a lawsuit. Examples include parents and siblings. It depends on who survives the decedent. Garcia Hong Law defended a transportation broker against a lawsuit brought by a plaintiff who alleges they were injured when they used a rideshare app. We presented evidence in a motion for summary judgment to have our client dismissed from the lawsuit. We argued that our client was not the employer of the driver of the rideshare app and had no liability for any injuries. Before the Court even considered our client's motion for summary judgment, the plaintiff dismissed the case. 🚨 Legal Update 🚨 On July 1, 2024, Governor Newsom signed SB-92 and AB-2288, introducing major changes to California's Private Attorneys General Act (PAGA). These reforms aim to curb frivolous lawsuits and provide clearer guidelines for employers and employees. Key changes include: Plaintiff Requirements: Plaintiffs must now have personally experienced all alleged violations within a one-year period. Increased Penalties Share: Employees' share of penalties increased to 35%. No Derivative Penalties: Limits on using a single violation to claim multiple penalties. Penalty Caps: New caps on certain penalties and provisions for "isolated" violations. Cure Provisions: Reduced penalties for proactive compliance efforts. Early Resolution: New options for early evaluation and settlement. On July 1, 2024, Governor Gavin Newson passed two bills that significantly alter PAGA, and some of the provisions benefit California employers, by imposing stricter standing requirements, decreasing penalties for compliant employers, and requiring manageability to litigate these claims, along with other changes detailed below. Notably, the changes do not impact cases filed or PAGA notices submitted before June 19, 2024. This new legislation is foreseen to have significant impact on California wage and hour law. Two highly anticipated California health care bills were vetoed be Governor Newsom this weekend. AB 3129 would have required notice to and, in some instances, approval from the California attorney general for certain transactions, such as acquisitions and/or changes of control of healthcare entities/facilities, involving a private equity group. Gov. Newsom indicated that the Office of Health Care Affordability (OHCA) already has power to review transactions, even though it by itself cannot block transactions. Gov. Newsom indicated review of such transactions is more appropriate for OHCA. Veto message found here https://lnkd.in/e62nxt8t. SB 966 would have required the state insurance department to license pharmacy benefit managers (PBMs). It would also have required PBMs to disclose prices paid to drug manufacturers and mandated 100% of any discounts negotiated be passed down to consumers. The legislation was meant to rein in anticompetitive practices of PBMs that drive up prescription drug prices and forcing independent pharmacies out of business. Gov. Newsom was not convinced the licensed scheme would achieve its objective and instead proposes that the California Health and Human Services Agency collect more data on PBMs to understand the total cost of care. The California Legislature has taken action to amend the California Private Attorneys General Act (“PAGA”) with some of the most significant changes to the law in its 20-year history.
