License Agreement for use of the Program “Yandex.Cloud” for Mobile Devices

This document is a translation of License Agreement for use of the Program “Yandex.Cloud” for Mobile Devices in English. In case of conflict between the Russian version of License Agreement for use of the Program “Yandex.Cloud” for Mobile Devices and this translation - only the Russian version of License Agreement for use of the Program “Yandex.Cloud” for Mobile Devices is legally binding. Before using the program, please read the terms and conditions of the below license agreement.

Any use of the program means that you fully and unconditionally accept the terms and conditions of this license agreement.

If you do not accept the license agreement in full, you may not use the program for any purpose.

1. General Provisions

1.1. This License Agreement (hereinafter referred to as the “License”) establishing the terms of using the program “Yandex.Cloud” on mobile devices (hereinafter referred to as the Program) and is made between any person using the Program (hereinafter referred to as the User) and Yandex.Cloud LLC, 16 Leo Tolstoy St., office 528, 119021, Moscow, a holder of the exclusive right to the Program (hereinafter referred to as the “Rightholder”).

1.2. By copying the Program, installing it on his/her mobile device or using the Program in any way, the User expresses his/her full and unconditional consent to all the terms and conditions of the License.

1.3. The Program may only be used under this License. If the User does not accept the terms and conditions of the License in full, the User may not use the Program for any purpose. The Program is prohibited to be used in violation of (failing to fulfill) any of the terms and conditions of the License.

1.4. The Program may be used by the User free of charge under the terms and conditions of this License for personal non-commercial purposes. Use of the Program on terms and in a manner not provided for by this License is possible only under a separate agreement with the Rightholder.

1.5. When using the Program, the User agrees that the following documents, the terms whereof fully apply to the use of the Program, form an integral part of this License:

The Rightholder may unilaterally amend the said documents (inter alia, any parts thereof) without any special notice. New versions of the documents shall come into effect upon publication, unless otherwise stipulated by the new versions of such documents.

1.6. This License and all relations associated with the use of the Program shall be subject to the laws of the Russian Federation, and any claims or actions arising out of or in connection with this License or the use of the Program shall be referred to and reviewed by courts at the Rightholder’s location.

1.7. The Rightholder may provide the User with a translation of this License from Russian into other languages. However, in the event of a conflict between the License in Russian and its translation, only the Russian version of the License will be legally binding.

2. Rights to the Program

2.1. The Program makes it possible for the User to manage the functions of the Yandex.Cloud platform (hereinafter referred to as the “Platform”) that the User enabled via the Management Console in a browser according to the Terms of Use of Yandex.Cloud Service or other relevant documents and to refill his/her personal account with a bank card linked to the payment account.

2.2. The exclusive right to the Program belongs to the Rightholder.

2.3. The User has read and unconditionally acknowledges that the Management Console means a closed section of the Platform, which can be accessed by duly authorized Users, where the User can order, set up, and manage the Services; containing links to User Guides for Services and other resources of the Platform as well as other technical documentation; Statistics Data on the Services used, information on the status of the Customer's Personal Account, his/her account details, User's Credit Limits, Quotas and discounts; providing means for the Parties to exchange notices and messages, perform other actions to make use of functionalities of the Platform.

2.4. The User has reviewed all the restrictions and instructions on how to use the Management Console via mobile devices through the Program, unconditionally accepts, and undertakes to comply with them;

2.4.1. Service control is possible for a limited list of Services as enabled by the Program;

2.4.2. Switching to the paid version of Services is not possible through the Program;

2.4.3. No request and provision of information about the period and amount of the Reserved Volume of Services is available;

2.4.4. No billing for Services and/or debts is available;

2.4.5. No information about Quotas is provided.

3. License

3.1. The Rightholder shall, free of charge and under an ordinary (non-exclusive) license, grant to the User the non-transferable right to use the Program in all countries of the world in the following ways:

3.1.1. To use the Program as intended, wherefore to copy and install (reproduce) it on the User's mobile device(-s). The User may install the Program on an unlimited number of mobile devices. When installed on a mobile device, each copy of the Program is assigned an individual number, which is automatically reported to the Rightholder.

3.1.2. To reproduce the Program for non-commercial purposes (free of charge).

4. Restrictions

4.1. Except when used in the scope and in the manner expressly stipulated by this License or the laws of the Russian Federation, the User may not modify, decompile, disassemble, decrypt and perform any other actions with the object code of the Program, as meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program, without the Rightholder’s written consent.

4.2. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent.

4.3. The User may not distribute the Program in any form other than the form received, without the Rightholder’s written consent.

4.4. The Program shall be used (inter alia, be distributed) under the name: “Yandex.Cloud”. The User may not change the name of the Program, change and/or delete the copyright notice or other references to the Rightholder.

5. Terms of Use of Certain Functions of the Program

5.1. Functioning of the Program is possible only if you have access to the Internet and with user account created under the Terms of Use of Yandex.Cloud Service. The User shall independently obtain and pay for such access under the terms and as per tariffs of its telecom or Internet provider.

5.2. The User is hereby informed and agrees that when using the Program to interact with other services and/or programs of the Rightholder, inter alia, upload files to, and copy files from, such services and/or programs, the User also fully accepts and agrees with the terms of use, license agreements, and other regulatory documents of the relevant services and/or programs.

5.3. All the data on the use of the Program transferred under this License shall be saved and processed in accordance with the Privacy Policy (https://yandex.com/legal/confidential).

6. Liability under the License

6.1. The Program is provided “as is”. The Rightholder provides no guarantees of error- and trouble-free operation of the Program or its certain components and/or functions, fitness of the Program for specific goals and expectations of the User, and provides no other guarantees, which are not expressly stated in this License.

6.2. The Rightholder shall not be held liable for any direct or indirect consequences of any use of or impossibility to use the Program and/or any damage inflicted on the User and/or third parties as a result of any use of, failure or impossibility to use the Program or its certain components and/or functions, inter alia, due to possible errors or malfunctions of the Program, except as expressly stipulated by laws.

6.3. The User is hereby notified and agrees that when the Program is used, the Rightholder receives the following information automatically and anonymously (with no reference to the User): type of the operating system of the User's mobile device, the User's mobile device model, program version and ID, user statistics on the use of certain files uploaded with the Program, program functions statistics, and any other technical information.

6.4. All questions and claims related to the use of / inability to use the Program and possible violations of laws and/or third-party rights by the Program shall be sent via feedback form at: https://console.cloud.yandex.ru/support.

7. Updates / New Versions of the Program and Third-Party Software

7.1. This License covers all future updates / new versions of the Program. By agreeing to install an update / new version of the Program, the User accepts the terms and conditions of this License for respective updates / new versions of the Program, if there is no other License Agreement for the update / new version of the Program.

8. Changes in the terms of this License

8.1. This License Agreement may be unilaterally amended by the Rightholder. The notification of the User about the modifications made to this License shall be posted at: https://yandex.ru/legal/cloud_mobile_agreement. The said amendments to the terms and conditions of the License Agreement shall come into effect once published, unless otherwise specified in the relevant publication.

8.2. Capitalized terms used and not defined herein shall have the meaning specified in the Offer for residents of the Russian Federation at: https://yandex.ru/legal/cloud_oferta or for residents specified in the Offer at: https://yandex.com/legal/cloud_customer_agreement.
